Terms of service
Draft for review. This is starting text written for pimbo and hasn't been checked by a lawyer. Review it before launch; highlighted items need a decision.
About these terms
These terms cover your use of pimbo, provided by pimbo (add registered company name, number and address). By installing pimbo on your Shopify store, or by signing in after a store owner invites you, you agree to them. If you use pimbo for a business, you agree to them on that business's behalf.
The service
pimbo connects to your Shopify store to bring in your products, inventory, orders and customers, and gives you tools to organise product information and plan stock. We keep improving pimbo, so features may be added, changed or retired. We'll tell you before removing anything you actively rely on.
Your account and team
- The store owner installs pimbo from Shopify and can invite teammates to use it outside Shopify admin.
- You're responsible for what happens under your store's account, including your teammates' use of it.
- Keep passwords to yourself, and tell us straight away if you think an account has been misused.
- Remove teammates who no longer need access from the Team page in Shopify admin.
Your store's data
Your store's data stays yours. You allow us to copy, store and process it only to run pimbo for you. Where that data includes your customers' personal information, we process it on your instructions and you remain responsible for having a lawful basis to share it and for telling your customers how it's used. Our privacy policy explains how we handle it.
Plans and billing
Paid plans are billed through Shopify, on your Shopify invoice. Prices and what each plan includes are shown in pimbo before you choose. Plans renew until you change or cancel them, and cancelling takes effect at the end of the current billing period. (Confirm the refund position.)
Acceptable use
Don't use pimbo to:
- break the law, or Shopify's own terms;
- try to get into accounts, stores or systems you aren't allowed to reach;
- copy, resell or reverse engineer pimbo, or build a competing product from it;
- overload or disrupt the service, including with automated scraping.
We may suspend access that breaks these rules. Where we can, we'll tell you first and give you a chance to put it right.
Availability and support
We work to keep pimbo running and your data synced, but can't promise it will be uninterrupted or free of errors. Sometimes we'll need maintenance windows, and Shopify's own availability affects syncing. For help, use the contact page.
Liability
Nothing in these terms limits liability that can't legally be limited, such as for death or personal injury caused by negligence, or for fraud. Otherwise, we aren't liable for indirect or consequential losses, or for lost profits, sales or data, and our total liability in any 12 months is limited to the fees you paid for pimbo in that period. (Confirm the liability cap.)
Ending your use
You can stop using pimbo at any time by uninstalling it from your Shopify store. When you do, Shopify tells us to delete your store's data, and we do so as our privacy policy describes. We may end or suspend access if these terms are seriously or repeatedly broken.
Changes to these terms
We'll update these terms from time to time and change the date at the top when we do. If a change matters, we'll tell you in pimbo or by email before it takes effect.
Governing law
These terms are governed by the law of England and Wales, and its courts have jurisdiction. (Confirm.)
